LEGAL STATUS

  • ADULT / NONMEDICAL: Not authorized
  • MEDICAL CANNABIS: State program authorized; eligibility rules apply
  • LOW-THC / CBD: Separate product and access rules may apply

Adult/nonmedical cannabis use is not authorized. Florida operates a physician-certified medical marijuana program for qualified patients and caregivers in the Medical Marijuana Use Registry.

POSSESSION

Registered patients and caregivers may possess only the amount lawfully ordered and dispensed under the medical program. Unauthorized possession can carry criminal penalties. There is no adult-use possession allowance.

PURCHASING

There is no adult-use retail market. Qualified registered patients and caregivers may obtain authorized products from licensed Medical Marijuana Treatment Centers within applicable physician-order and dispensing limits.

HOME CULTIVATION

Patient home cultivation is not authorized under Florida's state medical program.

PUBLIC USE

Medical use is restricted in public places and other locations identified by statute. Federal property, schools, workplaces, vehicles and local rules require separate attention.

DRIVING + VEHICLES

Driving while impaired is prohibited. Florida's medical authorization does not permit use while operating a vehicle, boat or aircraft.

EMPLOYMENT + HOUSING

Florida's medical law does not create a broad requirement that employers accommodate use at work. Employers, landlords and federally regulated settings may impose additional restrictions.

RECORD CLEARING

Florida does not have broad automatic adult-use cannabis expungement. Eligibility for sealing or expungement is case-specific; use the Florida Courts and FDLE official resources or a qualified attorney.

BUSINESS + GREEN EQUITY

The Florida Department of Health Office of Medical Marijuana Use regulates the medical program and Medical Marijuana Treatment Centers. Adult-use business licensing is not available.

HEMP / THC PRODUCTS

Hemp and hemp-derived products are regulated separately from the medical marijuana program. Product, age, packaging and retail rules can change; verify current Florida Department of Agriculture guidance.

SEPARATE LEGAL LAYER

FEDERAL CANNABIS LAW ♡

State authorization does not erase federal law. Federal controlled-substance rules, federal property, interstate activity, immigration, firearms, federally regulated work and federal benefits can raise separate issues.

In April 2026, federal action placed FDA-approved marijuana products and qualifying state-regulated medical marijuana products in Schedule III while maintaining strict federal controls. That change does not mean every state-authorized activity is federally lawful.
